1. Acceptance of Terms

By registering for or using SiteReport ("the Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not use the Service.

2. Description of Service

SiteReport is a web-based platform that allows professionals to create, manage, and share site inspection and energy audit reports. The Service includes project management, issue logging, photo upload, and report generation tools.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use SiteReport. By registering, you represent that you meet these requirements.

4. Account Registration & Security

• You must provide accurate and complete registration information.
• You are responsible for maintaining the confidentiality of your password.
• You must notify us immediately of any unauthorised use of your account.
• You are responsible for all activities that occur under your account.
• One person or legal entity may not maintain more than one free account.

5. Acceptable Use

You agree NOT to use SiteReport to:

• Violate any applicable laws or regulations
• Upload or share content that is unlawful, defamatory, obscene, or infringing
• Upload malware, viruses, or any malicious code
• Attempt to gain unauthorised access to any part of the Service or other users' data
• Reverse engineer, decompile, or disassemble the Service
• Use the Service to generate reports containing false or fraudulent information
• Resell, redistribute or sublicense access to the Service without written permission
• Use automated scraping or data extraction tools against the Service

6. Your Content

You retain ownership of all content you upload or create using SiteReport ("Your Content"), including project data, reports, and photographs.

By uploading content, you grant SiteReport a limited, non-exclusive, worldwide licence to store, display and process Your Content solely for the purpose of providing the Service to you.

You represent that you have all necessary rights to upload Your Content and that it does not infringe any third-party rights.

7. Data & Privacy

Your use of SiteReport is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described therein.

8. Subscription Plans & Payment

SiteReport offers a free plan and paid subscription plans. Paid features will be clearly indicated in the app. By subscribing to a paid plan:

• You authorise us to charge the applicable fees to your payment method.
• Subscriptions auto-renew unless cancelled before the renewal date.
• Refunds are considered on a case-by-case basis within 14 days of charge.
• We reserve the right to change pricing with 30 days' notice.

9. Intellectual Property

SiteReport and all related technology, software, branding, and content (excluding Your Content) are owned by SiteReport and protected by intellectual property laws. You may not use our trademarks or branding without written permission.

10. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We do not warrant that the Service will be uninterrupted, error-free, or secure.
• Reports generated via SiteReport are tools to assist professionals — they do not constitute certified professional assessments unless signed off by a qualified auditor.
• Our total liability to you for any claim shall not exceed the fees paid by you in the 12 months preceding the claim, or £100, whichever is greater.
• We shall not be liable for indirect, incidental, special, or consequential damages.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under English law.

11. Indemnification

You agree to indemnify and hold SiteReport harmless from any claims, damages, or expenses arising from your use of the Service, Your Content, or your violation of these Terms.

12. Termination

Either party may terminate these Terms at any time. You may delete your account in Settings. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

Upon termination, your right to access the Service ceases immediately. We will handle your data as described in our Privacy Policy.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to Terms

We may update these Terms periodically. We will notify you of material changes by email or in-app notice with at least 14 days' notice before changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
